what's up with the cease and desist?

    Can anyone enlighten me? I mean most of the 3p products do strike some resemblance with the characters they are doing, but they are not direct duplicates of them.

    Neither do the name of the character or the products in general are called "Transformers" or the character they are representing, I'm talking about fan made stuffs like the combiners etc.

    The most recent one is Omega Supreme, the mold is questionably very similar to the G1 version.

    But what's up with stores who are selling 3p products getting the cease and desist letters?

    You should probably use the search function. We've been over this a million times already.

    As far as we know Kapow got a C&D over FansToys Grinder after a Hasbro employee bought Grinder-related products from Kapow's booth at TFNation because it looks too much like Grimlock (particularly MP-08). It was a wrong place, wrong time situation where the Hasbro employee couldn't just pretend to look the other way.
    Again, as far as we know, that's all there is to it, and there are no other cease and desists out there except for one targeted at iGear from at least a few years back.

    And also, I suggest avoiding yet another thread about law discussions when most people on TFW aren't even lawyers. I could tell you a few things I loosely know but they may or may not be correct, so what I'm going to do is say this: if you're not sure but you want to know for sure, go ask an actual lawyer and leave the lawyering to people whose job it is to figure out these things.

    Search function sux. I was trying to find a particular sales thread for a particular person. It came up with a different sales thread using his name. So I pm’d the guy and asked if they still had a particular item, as it looked like they had deleted that sales thread. He said he didn’t delete it. But he no longer had that item for sale.

    So I did a search under the item I was looking for and among all the sales threads (and threads that weren’t sales threads where said item was mentioned ) up came that person’s other sales thread.

    You would think that using a search under that person’s name in the BST forum would have been more effective and popped up all sales threads started by them.

    I’ve often had better luck using google to find stuff on tfw.

    So for me, personally, rather than doing something that I find rather dickish and telling someone to use the search function I decide to be cool or not and actually engage the the person. If you don’t want to be bothered then scroll past the topic to another topic.

    i use google to search for threads if i can't find them , the search function on tfw2005 is not always that good

    As poorly executed as it was, whoever created that fake Terminus C&D should be proud of themselves. It's managed to frightened, upset, and enrage a lot of folks.

    The search function is fine. How is it "dickish" to expect someone to do a basic search instead of creating repeats of existing threads?
    I just did a search in this sub-forum for "cease and desist" and found all the related threads (including the one titled "Fanstoys legal issues with Grinder") on the first page.

    It all comes down to laziness and instant gratification. If a topic has been answered and it's a current topic to boot, why create a new thread?

    Plus, it's considered spam. Staff has on multiple occasions merged threads and combined multiple posts because if a topic already exists, a second one isn't necessary.

    This shouldn't have to be explained, honestly.

    When I need that info, I just Google the username and TFW. BST are usually the first search result.
