That's not it at all. The Romeo and Juliet law in Texas is that a person that is up to 3 years older than another but no more than 3 years, can engage in consensual sex if both parties agree. Meaning Shane being 20 and Tessa 17 is legal by state law but they can also engage in sex when she was 14 and he 17. Anything under 14 is not allowed by law. But if he had been 4 years older than her, it would have been illegal for them to have any sexual relations until she turned 17. So they definitely got past the system because she was over 14 when they started dating and they were only 3 years apart. But without this law in Texas, the legal age if consent is 17. Its 16 in my state.

Still, I don't think that's the point that the movie was making, so it's stupid that it's that big of an issue.
It's referencing to people in your age range. Example, like Shane and tessa: Shane started dating tessa when he was a senior and she was a sophmore. By the Romeo and Juliet law, once shane passes 18 years of age, he can still date tessa, especially since she's 17 now (the age of consent in TX).
Actually he's talking about the scene where the K.S.I agent holds down Tessa on the ground, sitting arounf her crotch area and pressing her head down on the ground. A lot of people are not happy with that scene.
