My guess is that the shoulders, wings and arms are mounted on the flaps, and those are connected to the lower part of the body. The shoulders have to extend from the flaps to connect into the chest, so that's why they can't be left flush. That's probably why its diecast, so it's strong enough to support the whole shoulder assembly.

For the last time people, Hastak has limited budget on their disposal. They could hire a law firm to wipe every single 3rd party/KO company in existence and going bankrupt in the process. They got like three different toyline release simultaneously.

Why is Weijiang got raided was because of their Iron Man KO and it being Disney's property, it doesn't end well. Hasbro got involved for free basically.
The Studio Cell case is because Zeta got cocky and doing a fundraiser at the same time as the Haslab version. Even then it doesn't stop them and currently on third repaint and there's the upcoming Primus figure.
Flametoys threaten to C&D any company that KO their figure (and design). Just looks how well it went.

These company works like mafia logic. As long as you don't step into their territory, they gonna turn a blind eye. But sometimes it's nothing but an empty threat.

 

Drawing from this, I think right here is the point that everyone is missing. So hasbro decides to sue a company. Big deal. 3p as a whole wont stop just bc x company got pressured/sued/raided. They just change names and go again. And right there is the reason hasbro doesnt do anything unless it is something that might directly harm their own sales. For all the power people think hasbro has i highly doubt they could take down the entire 3p industry. Even if they could it would only be temporary.

Then there's also the fact that because 3P toys aren't knockoffs of existing Hasbro toys, they may have a high chance, but that don't have a 100% certainty of winning a lawsuit.

I mean if DC a few months back lost a trademark dispute to this in Chile anything's possible.

 

Considering the amount of lawsuits they would have to file against the numerous companies, not having an open and shut case, would be a huge waste of money. And while they may or may not give a shit about the fact that 3p companies are "ripping them off" hasbro isnt dumb enough to risk that kind of money. Lawyers aint cheap.

 

You know who else makes toys that should inflict on copyright if not for subtle differences that keep them outside court while maintaining enough of the original design to make its "inspiration" easily recognizable?

This is just a case of corporate incompetence. If Hasbro hired the right lawyer, they could end it all, 3rd, 4th,…nth party. This guy never loses.
