Should I ask for a partial refund?

    I bought a G1 Micromaster lot on ebay containing: Greasepit, Ironworks, Hot House, Airwave, Roughstuff, Overload, Flattop, Cannon Transport with Cement-head & Terror-Tread, Missile Launcher with Retro & Surge. Most of them had their instructions. Paid a total of 115 bucks. All of them was supposed to be "complete and in good working order." The picture was blurry, so I couldn't tell if that was the case. But as it turned out Ironworks missile was broken, Roughstuff was missing the dual cannon, Greaspit was missing the missile post and it didn't include the right Micromaster Greasepit but Mudslinger, the repaint. Should I contact the seller and ask for a partial refund? If so, how much? What would you guys have done?

    If they were listed as complete but you received them incomplete, you're entitled to a full refund, not a partial one, as you didn't get what you paid for.

    If I paid $115 for something and it wasn't in the condition advertised a partial refund would never be an option. I already would have contacted the seller for a refund and, barring that, opened a PayPal dispute.

    Unless you're going to keep half the figures or something but I'd just send them all back, personally.

    id contact the seller and let them know. sometimes i just wait to see how they react. they might offer a decent solution. thats a possibility too, but def contact them, dont just let it go.

    I'd start by contacting the seller immediately and politely pointing out the errors - there's always a chance it's an honest mistake and they'll offer to compensate you accordingly.

    If you're dissatisfied with their response, you can always escalate it to eBay - it's sounds like it was genuinely mis-listed, so you've a good case.

    I wouldn't let it slide. I'm leaning towards saying the seller knew well, or should've have known.

    Absolutely shouldn't let it slide. I don't know about the full refund, but you should definitely get a pretty fair amount back, given that he lied.

    Could you send the listing? I'd like to see his exact words.

    I think that in this situation, a partial refund to compensate you for the damaged, incomplete, and incorrect part of the listing will suffice. Aside from the issues you've documented, you seem to be satisfied with the rest of the lot. Am I correct in assuming so? It's all a matter of agreeing on what amount you feel should be refunded to you. But remember to be polite and to present your case in a civil manner. Don't react as if you're using a computer keyboard for the first time in your life.

    +1 on this, even at this point, you are still in haggling mode so to speak with the seller, so being polite helps! If you are partially satisfied, work out a partial refund that is fair for both you and the seller. If you aren't satisfied in anyway with the lot, ask to return them for a full refund, but keep in mind how much more you will likely pay for the same lot in excellent condition if the listing had a bunch of nice clear pics to go with them.

    Exactly! That's why I only mentioned a partial refund.

    Yeah, as they were cheaper than buying them separately as well as having to pay for separate shipping charges for each item I'll rather keep them than having to return them to the seller.

    Anyway, here's what I wrote:

    "Hi! Got the Transformers yesterday, and most of them were great. Though some wasn't as described. Ironworks missile was broken on two places, Roughstuff was missing a cannon, Greasepit was missing a missile post and it included the wrong Micromaster. In my opinion these figures weren't as described, and I'm not completely satisfied with them. Let me know what you think!"

    And here's the reply I got:

    "Hi, I am sorry that you are unhappy with the description of the Micromasters. I did state that they were in good working order, not perfect. As far as I was aware they were complete and when they were posted there was no damage. As for there being the wrong micromaster, I didn't state which ones were there. What was in the photos was exactly what I posted to you. I though the photos were clear enough for anyone interested to see what they would get. Please accept my sincere apologies if you feel misled in any way as it was not intended."

    I think I'll just give the seller negative/neutral feedback and leave it at that.

    Edit: This was the only description, "Original 1980's Transformers Micromasters. 5 with instructions 4 without. All complete and in good working order."

    And, the missile was definitely not broken during shipment.

    That's what I would do. It sounds like the seller didn't intend to misrepresent the items. To me, pursuing it any further wouldn't be worth the time and trouble.

    That's the line that gets me, he is subtly blaming you or USPS for the damage, yeah Id just leave bad feedback.

    You can always contact eBay at this point, lay out the facts and just ask for advice. They're impartial so they can advise you whether it's worth pursuing further.

    Reply by pointing out where they're wrong (again, remain civil). If they're still refusing to do anything about it, but you have proof that a portion of the lot isn't as described, then go ahead and file a claim. And make sure to document your email exchanges as well as a copy of the listing (links, screen caps, photos, etc.). This will make for a stronger case. If during the claims process, they still won't work with you, leave your neutral or negative feedback.

    I hate giving eBay sellers negatives reviews. I've only left one or two in my 10 years as a member. I always try to work something out first.

    "I thought it was complete" and "Good, working order doesn't mean PERFECT working order" are not acceptable excuses, plain and simple.

    I agree with Satomiblood, follow up with eBay and be ready to leave negative (NOT neutral) feedback.

    Is eBay and paypal the same as far as backing up buyers? Obviously since he got broken stuff who does ebay help if sellers says it broke during shipping

    I would file a claim as well

    Paypal definitely supports the buyer unless hard evidence can be presented from the seller.

    I would ask the seller for a partial refund and see what he says before jumping the eBay/paypal case route. You didn't mention a partial refund in your message to him, so I'm not surprised he didn't respond with an offer of a refund. In the reply I would be a bit more stern and mention that how this is handled is how his feedback will be handled. That slight push is usually all I need to make things right. With a blurry pic and not much of a description, you will likely be able to work him over for a larger refund than eBay would give in a case settlement.

    You don't need to document your e-mail exchanges if they were all done over eBay, they can look at the e-mails that were done through the site during a disputed item case.
