About a month ago, i bought a United Tracks and Jazz from a seller in China. About five minutes back they turned up on my desk...(fairly flimsy) shipping box is just big enough for the two of them laid end to end, and was crushed at one end. Jazz's bubble is smushed fairly badly in the top left corner. Tracks' bubble looks like someone dropped a few books on it. Could i file an 'Items not as described' with Paypal for something like this? Toys themselves appear undamaged...but to me at least the box is a fairly important thing, and it's apparent whoever packaged these really did not give an *expletive deleted*. Anyone? Thanks.
^ Thanks. Jazz...the damage on the bubble could happen even in transit from the factory. Tracks took a nasty dent though (irony?) Seller has offered me 15% back. Would appreciate thoughts/comments on what people reckon is a fair percentage Thanks.
Sellers ARE NOT responsible for in transit, damage, HOWEVER they ARE RESPONSIBLE for adequate and safe packing methods, You can work things with him and ask for a solution, a partial refund should be fair enough or if the boxes thing is too important for You, then return the items and ask for 2 new ones.
yes they are, it does not matter to paypal or ebay. if it arrives damaged or not the way it was described for any reason, then you have a claim, no matter if you purchased insurance or not. the insurance is to cover the sellers ass. sellers try and act like if the item gets destroyed in transit then it is not their responsibility, not according to paypal or ebay. basically the seller is responsible for the safety of that item till it is in your hands. i do agree however, try and talk to the seller and see if you guys can work something out.
just remember that you will be responsible for trackable shipping to the seller...which is in CHINA and figure that costwise is it worth spending the $$$ to get your $$$ back....otherwise you could ship back for an exchange and possibly have the seller not send the new ones.... most of the time it is not cost effective to spend for trackable shipping to get a refund...paypal will just go straight for a you return it to the seller for a refund solution if you file a not as described case.
Thanks for the input everyone. Unless he offers a substantial percentage of the original cost, it's probably not worth the bother, and it wont solve the actual issue at hand. I think i might suggest to him that i buy another one, HE covers the shipping cost, and then i'll ditch the damaged package one locally at a discount.
Agreed, sometimes, its just not worth the trouble, and this would be one of those times IMO. I'd take the %15 refund though.
