Need some help with something I sold on eBay

    Recently I sold a THS-02 Hybrid Style Convoy, item was made in 2006 and is currently MISB. Item is factory sealed, and now the buyer is saying that there is a factory defect and wants his money back. I believe that I shouldn't accept the refund because how am I supposed to know if there are any issues with something that I never opened!! I called eBay and see if they could just close the case and after talking to someone in the escalation department I have to accept the return because their guide lines say since it was new and there was an issue.

    Am I right, also since he opened the item shouldn't that release me from responsibility?

    So I the way I see is that now I have to open all of my Transformers before I sell them to make sure that there are no issues. Which there is no way in hell I would do that because they wont be worth as much. And I told the person on the phone, since now I have to open everything to make sure there are no issues now everyone would have to open whatever their selling. (NOT OFFICIAL JUST MY INTERPERTATION OF THEIR GUIDE LINE!)

    Need opinions Please.

    It sucks.

    Accept the return and move on. It's just part of the deal when selling on ebay. The key is to look at overall sales in the long run and not get hung up on particular bad transactions. Otherwise you'll lose sleep and lose your mind.

    You should've listed your auction as absolutely no returns if you open item and item comes as is. View pictures carefully before you buy. If you do not agree to these terms, do not bid on or purchase this item.

    Your listing is a contract and you need to protect yourself.
    Only way ebay could force a return is if the new/sealed item wasn't opened. Once they open it, your contract they agreed to stipulates that's it, they own it and you aren't taking it back. Sometimes your contract can hurt you more by what's not in it, than what is.

    Ask for a detailed explanation on what the issues are and with pictures to illustrate those issues.

    My advice in the end would be to settle on a refund, but only on a return of the item to you (on buyer's expense of course). If the item was not found to be defective, give a partial refund equal to the value of that item in the current state (ie opened).

    i had some **** complain about something and wanted to return it for a refund, i agreed.
    he gave ebay/paypal tracking number on the return so he got the refund, i recieved an empty box...got his money back and took my items

    Right, I have a THS 02 Convoy and because of it's size some parts can be a bitch to move. Ask for clarification on the 'hinge that won't move' pictures and wot not.

    I've had this happen before. I sold someone some third party sealed figures (still shrink wrapped) and he accused me of selling him stuff with missing parts. He went so far to say that I had opened the items and kept some of the pieces. Seriously? They were sealed and shrink wrapped! I didn't say it, but I was thinking "are you a complete idiot?" Even though it was the manufacturer's fault, I took full responsibility for it. I gave him a full refund and allowed him to keep the items as well. How's that for customer service. He eventually apologized for his accusations, and we smoothed things out. Sometimes you just have to come to some sort of agreement (return with full refund, partial refund, etc.) and move on. It's not worth wasting time on certain people.

    I'd get him to return it in this case

    Hopefully he is just being a dick and not actually dishonest.

    Better to have the item and lose a little than the lose it all.

    When i list sealed items, i mark them as "used" with the note "mint in sealed package" or "unopened". I am not a store and the items i sold werent new. Also list in the fine print that you are not responsible for manufacturers defects.
    did you try contacting ebay and telling them since the item was unopened, the buyer must have broken it while handling it?

    Tried that, but their stupid guidelines prevented them from just closing the case in my favor.

    Maybe I'm alone, but shouldn't sellers have to take responsibility for whatever defect the product has? It shouldn't be up to the consumer to deal with the consequences, they paid good money for an unbroken item. If it's broken, it shouldn't be on them to just deal with it.

    Now, people being dishonest is an entirely different story.

    With this situation, I'd like to know exactly how "broken" the item is.

    As others have stated, the language in the listing is VERY important. Just take it as a lesson for the future.

    OP you are out of luck...refund and move on. A curse on the scumbags who take advantage of ebay sellers and vice-versa.
