My boss fired me cause of school

    Like the thread title says, when my boss fired me last Saturday, he goes I have no more room for you and I am having a shortage of work. I mean really before Christmas? Shows he has no compassion whatsoever. When I went today to pick up my last pay, he goes to me the real reason why I fired you was because of school, I can't have an employee here who goes to school and work at the same time, and that will put his work performance less than normal. He always criticized me due to the fact I go to school, like why do you go to school work instead make money full time, school is for losers, and your 32 years old what are you going to accomplish with it? Well now the thing is he will put in for my unemployment insurance that I quit. Is he allowed to fire me cause of school, and put on the paper that I quit?

    Depends on where you work, but if he believes that your performance suffers or will suffer due to your schooling, he may be within his rights to do so. If you honestly want to bring legal action against him, talk to a lawyer instead of us, and stop publically disclosing details of your case.

    If quitting as opposed to being terminated diminishes your unemployment benefits, DEFINITELY lawyer up.

    Whether he can fire you is a question I can't answer. But he absolutely can NOT fire you and then say you quit. That is highly illegal. You need to report him if he tries that.

    Pretty sure you were laid off & not actually fired, but yeah... I'm not gonna play Lawyer here hah.

    Well if he fired u then u can get unemployment but if u quit then u can't. That's how it is in Cali. Me being a store manager we have to be truthful if I fired u I can't say u quit. Not sure how it works in canada

    Report him. If he says you quit when he fired you, that is illegal. He is not above the law, so report him and get it over with. He is trying to deny you your unemployment insurance I assume, so do tell the cops or whoever can handle such a case.

    Pretty sure a boss can fire you for any reason he wants, so long as it's not based on your race, religion, gender, sexual orientation and a couple of other factors. But saying you quit when you were actually fired isn't kosher and you should fight that.

    As for the job itself, sounds like you are better off without it than working for someone so ignorant.

    He fired you just because of going to school. I can understand that if you're failing all your classes or you've been causing a ruckus at school, but not for flat out attending. That's like not giving a kid a hug because he has teeth.

    Ow, and report him. He shouldn't write down "he gave up'' when you actually didn't.

    I had that sort of happen at Best Buy last year.

    I had been working there for more than 5 years and the store's new GM tells my supervisor to tell me in July that I have to quit when I started Student Teaching in Aug. He said that I could not "meet" his scheduling needs to work every Friday/Sat/Sunday since Student Teaching was Mon-Fri. I asked to go seasonal, which meant I only would have to work one weekend a month, but then after I was told that was okay, he then told me even seasonal employees have to work every Fri-Sun.

    It turned out that because I was graduating with my Master's, he felt I was over-qualified to work for his store and did not want someone who wasn't just a drone working for him.

    Fortunately, it bit him in the ass because they lost a lot of my regular customers and they lost the one person who knew nearly every and anything about movies and games.

    Oh, and I was also denied unemployment even though no one from Best Buy showed up to the hearing. -_-

    You're in Canada...so we USA folks can't really suggest anything but to talk to your local employee labor group...government branch, etc. Here, we have Employment Security offices that can offer some advice, just not sure what you have there....Or as others suggested a lawyer that specializes in labor issues.

    I'm 31 and I am returning to school. I guess that makes me a loser too. How was your work performance? If it was good and you had a everything balanced out between school and work, then I say you being fired was wrong.

    Dr Kain, feel sorry for you. That sucks. I hate that overqualified thing. Many people I know were denied jobs because they had a degree. They forget that some people just need jobs. Some people may like a retail job over a teaching job, you may never know.

    How has the hockey shut out affected bars and restaurants? Are you in downtown?

    Also there are still tons of openings. If you're looking for a part time or full job, look me up. We have tons of openings.

    The hockey lockout has literally devastated sports bars, especially those close to the arenas in major cities (or those with a team). Some of the minor leagues are picking up the slack, but there's been a bunch in the news about how it's been a big decrease in business over last year.

    Stupid people in positions of power love to mock smart people, or people who are trying to better themselves. He's just jelly, plain and simple. He fears the day when you'll be above his abuse.

    I'd say the best thing for you to do is call "Normes du Travail" and consult with them about your situation
