technically 3p are not using ip, they are using likeness. 3p arent branded as transformers, autobots, decepticons, dont use the names etc etc. they do however use the likeness of official characters   (just throwing some silly semantics out there so that things stay light haha)

Maybe it would be easier to find a 3d model and print it. But I know someone posted a picture / link to a site here, where you can buy small ducks made of resin.

 

I think we can all look up the dictionary definition of 'Fake' but what I am saying is they are not REAL Transformers they are not genuine; they are counterfeit; are imitations; lookalikes...all synonyms for fake. I agree they are not knock offs or forgeries in the sense that they are not exact copies of existing products buy they are products that seek to represent the lines of properties that they have no licence to reproduce.

 

legitimately curious, but in the case of mmc oberon (using this as an example since its a fairly original design for the character) would it really be ip theft or copyright infringement? its not branded as a vehicon or as obsidian, not branded as a transformer and barely has any resemblance to the character aside from his head.

 

Smallest I can find is 1 1/2" which I think is way too big. Maybe Etsy would work. If TRU wasn't closing I'd check out the Barbie's to see if there is a bath time Barbie.

 

I just googled "small rubber duck toy". There's loads of options. Megatron didn't take his duck out the cupboard until after he turned Transmetal though of course, in fact he didn't bathe much in season one until the last few episodes of the season. Last word on this (just because you asked). I'm not legal expert and I expect there are grey areas but if taken to court I expect the 3rd party would need to prove that their product wasn't created in the likeness of HasTak's IP and wasn't specifically desired to profit off that likeness. To my mind they haven't really got a leg to stand on but clearly HasTak haven't the appetite to go after them, which I'm quite thankful of tbh.

Just edited my post with a link to one. I don't know how accurate they are to Megatron's duck though, they seem to come in bulk packs cheap though so maybe a few cracks at painting them won't be a big deal.
