Yes. Though on the other hand, as the guy apparently mentioned in his Twitter, even if they'd asked, he doesn't have permission to allow them to use the designs, either, since they're not his licensed property.

The situation is kinda unfortunate. I definitely want to see companies venture out and do ideas like this beyond recreations of G1 or IDW characters, and while I like Beast Wars, I do prefer the more robotic animal takes of the Transmetals instead of the Season 1 beasts, so this idea aligns in spirit.

They could've found a way to credit the artist. Have him do box art or comics or something.

Awh some people on this thread are annoying, get over it its a different primal, how many jazzs is there anyways, not only jazz but devastator, and the dinobots these are some examples of third party's repeating them selves over and over ( I wouldnt mind I like the characters I just mentioned but seriously we need a change and this is a perfect example of change)
I for one dig this not because its beast wars related but because its a newer look for primal. If you dont like it fine but dont go saying shit about bw, I couldn't give a shit about g1 but you don't see me saying it even doe everytime they repeat themselves and bring out the same figure again and again o_O o_O

He doesn't want to be affiliated with the project lest he jeopardize a business relationship with TakaraTomy.

These designs are a derivative or a derivative. Why would anybody expect them to ask permission from the artist when A) it's not his permission to give and B) companies don't ask any of the other artists that are actually officially licensed and paid to draw TF?

Do you think they ask Alex Milne, Don Figuera, etc. for permission to use their specific interpretations of the characters?

There's a difference between referencing specific designs (Optimus as a semi cab, go on) and ripping off the entire idea of G1 characters with beast modes, then stealing those beast modes, then stealing those actual designs.

Like, at least have the decency to come up with your own designs. Even if you steal the idea of Rodimus as a tiger.

Doing the Milne and Figuera designs is more than copying the concept. That's the original G1 concept. Companies have copied their specific aesthetics almost line for line and nobody bats an eye.

This entire industry is based on copying IP. I'm not sure why unofficial fanart IP that's a derivative in itself is more sacred than the actual original IP.

    Totally clear?

It seems that something like an image will be released with a non-genuine transformer toy,
It closely resembles what I drew in doujinshi as a hobby before.
I am not a mass product sketch drawn for these non-genuine items.
In addition, I did not issue permission, because I am not the copyright holder.

Well realistically if this guy was collecting a check it might be a terrible idea to broadcast it on Twitter.

He wouldn't be protected by IP laws. None of it is his IP.
