I bought a sealed item off of a guy on ebay, when I got the item it was exactly as the seller described. Sealed. When I opened the sealed item I found that the figure was broken. Should I request a refund? Should I just take this as a loss? I feel bad trying to get a refund when the item that I bought was as described, and the seller was great. Any advice would be greatly appreciated.

I'd contact the seller and let him know that it was broken. From there, depending on his response, I'd ask if he could send you a new one or refund you.
This. If he's a responsible seller it's insured and you're both covered. If he's not, speaking as a seller, it's a good lesson for him to learn. Insurance is free up to $50 with Priority and isn't expensive to add above that nor is it expensive to add insurance to First Class.
Alright, then i'm going to ask for a refund. I sent him a message asking him to work something out. Maybe do a partial refund only. I'm trying to work with him since I know this isn't his fault. His lack of response is bothering me, though.
So the box wasn't damaged from shipping and wasn't broken from being crushed? If that's the case, I don't see how the seller is responsible, unless it had a window box and you could see it was broken before opening it, or it's an actual store on Ebay that can deal with damaged items.
I say its tough luck. It was a sealed item & the seller did his part. Not his fault it is broke in the package.
If anything, this sounds like a poorly produced/manufactured action figure, which is not the fault of the seller. I would contact the seller and inform them of the situation and hopefully, you both can come to a happy medium. More often than not, the seller will ask you to return it and refund the amount. Perhaps you can barter for a partial refund if you want to keep it. This sounds like a DC Direct/Collectibles figure, which is notorious for poorly manufactured figures. I can't tell you how many times I've purchased a figure and had a limb fall off right after opening, or had a part bouncing around the blister before I opened it.
The seller and I spoke. We agreed to a partial refund. I think this is the best solution as it's not really his fault. I will keep the broken figure (I guess sell it as a junker). Thanks for your advice everyone.
Cybertron Snarl. The left arm is broken (The pin is hugely off center). I don't think there is anyway to fix it because almost every joint on that toy has a pin.
I've never been able to pop a pin without breaking the figure. The plastic is slightly cracked around the shoulder.
I'd say you got lucky. For such an old figure, you take the risk of getting a defective one when it is misb. I mean, if I buy a misb marvel legends 8 Iceman, and he explodes after I take it out of the package, that's on me.
