The things that is a shame for this is that he will probably get a settlement just do to the cost of a full blown trial. All he really deserves is a Darwin.

Really, because I thought the reason why I claimed that keeping the "coffee near the same temperature it takes to make it was a clear sign that I've read the article.
Despite so, due to my knowing that accidents can happen with me, I will not handle anything hot unless I have a smooth stable surface to put it on. I'm smart enough to determine the temperature without making contact with it. (Except that one time I touch a wire bound resistor, the heat didn't transfer to the air, as liquids can.) Heck, if when I use a soldering iron at my job, I'm not going to change the freaking tip of it until I know that it temperature of it doesn't make a sizzle noise when it makes contact with a sponge.
Heck I spilled even cold drinks in the car. I don't care if the temperature is the freaking boiling point of water, unless the cup broke apart because of the temperature, still I don't think it was their fault.
Oh, resturants are now serving food in skillets (still sizzling) to the customer, should they get sued if the customer knocks it to their laps? I'm not claiming this happened because of money. People just aren't thinking. Now back on topic...
Do you honestly think this kid's case is comparable? It's so far out of the realm of acceptable behavior on his part that it bears no resemblence to spilling overly hot coffee by accident.
