Zavvi canceling European orders for HasLab Victory Saber set

    I recommend checking your civil law codexes. In the Polish interpretation of civil law:
    "The person who performs the contract must exercise a certain level of diligence. The regulations speak very generally about "due diligence" (Article 355 § 1, Article 472 of the Civil Code). Performance of the contract without due diligence means fault in the form of negligence, and this may result in liability for non-performance or improper performance of the contract.

    In contracts between a consumer as a buyer and a professional entity as a seller, it is justified to adopt an increased standard of diligence in informing the customer about the properties of the goods. In contracts where there are professional entities on both sides, professionally engaged in activity in a specific field, there are no grounds for fully transferring the risk and burden of the wrong choice of goods (e.g. construction material) to the seller."

    We as consuments have our rights and in case of product like this we can assert our rights. Today I need to write few pages for Uni but tomorrow I will write consumer complaint to European Consumer Center. I recommend you do the same to your country branch. When we make enough complaints, the EU's legal machine will finally kick in and maybe we'll get something out of it.

    Also if you want whole and proper response from Zavvi, give them 1 star on Truspilot.com, weird how fast they respond there.

    You say unlocated figures, but did Zavvi put the order through to Hasbro? And did they order the right amount?
    Did the factory make a mistake? Did they lose them on sea? I find that unlikely.
    This will be a blame game and you'll never see the truth.
    What I do know is that logistically for ZAVVI to have abruptly cancelled that many orders someone has screwed up big-time. And I would not be surprised if it's at ZAVVI's end.

    That's my recollection as well. What makes peeps think things will be different this time round?

    You have put considerable effort in this post. That's very nice of you.

    Not to take away peep's legit grievances but this is a first world problem in the overall scheme of things for the European Consumer Centre. And Zavvi are refunding those who received notification of cancellation, where applicable. If this could hold water, Amazon would not be fit to run a business given the amount of times preorders have been cancelled.

    Hasbro is not profiting from scarcity. Hasbro is profiting from sales. The more units they sell, the more profit. Scarcity means fewer units sold means less profit.

    I feel for the Europe fans who encountered this problem.
    Probably not totally related, but I would like to talk about the water damage problem of Taiwan' Victory Saber batch.
    Tl;dr: I think the water damage problem probably makes more Taiwanese collectors preorder Deathsaurus directly through Hasbro shopee.

    I was worried about the yellowing problem so I had a deal with my friend-I would buy a second-hand Victory Saber from him if it doesn't yellow that fast.
    My friend preordered two through a retailer and both were cancelled.

    We don't have Hasbro Pulse in Taiwan, so I think Hasbro shopee is probably the only official way to preorder Haslab stuffs in Taiwan.
    Some collectors used to preorder haslab stuff through retailers because it's much cheaper(10-20% off),

    When the water damage problem happened, Hasbro shopee doesn't have enough numbers so they cancelled all retailers' Victory Saber,
    only those people preordered through Hasbro shopee get a free Orion Pax &Alpha Trion 2-pack(I heard these from a retailer, he also said it's impossible for him to send a free 2-pack to those who preordered through him).

    I remember I could still preorder Victory Saber in Hasbro shopee site in June 2022(Hasbro shopee probably got enough numbers) but Deathsaurus is sold out now,
    so some collectors here, me included, believe the water damage problem made more Taiwanese collectors preorder Deathsaurus directly through Hasbro Shopee.

    Many Taiwanese collectors whose Victory Saber was cancelled said they used shopee discount coupon when they preordered in 2021.
    Taiwanese can still get a Victory Saber through retailers now, the price is at least 120%, and the batch probably comes from China.
    Some collectors have their conspiracy theories on this situation, but there is no proof.

    The water situation alone warranted Hasbro to make new product. Did they or did they really just cancel orders and say sorry?

    So since Hasbro marketing and design department are looking at this forum, can we assume they know about this problem at this point?
    Also I wonder if all copies Zavvi did sent where from that first moment they charged for VS.

    They've actually lost out, in reality.

    They've already had those people's money for a year. Until they know the scale of the problem and have a plan to replace it do you really want them to sit on those people's money for another year?

    I, too, am rooting for someone to violate IP law for our benefit.

    They probably haven’t? If Zavvi didn’t report those orders, as we suspect, then Hasbro never got those numbers nor the funds, surely. Which means VS backer numbers would have been higher than previously know, as well.

    TF NL, which is a serious store, carried the project and also the Hiss Tank. Zavvi was not the sole distributor and quite frankly i never considered from a millisecond to order from them because of their terrible track record with collectors items.
    tldr and my last message in this thread: stop ordering rare things on Zavvi because everything collectors related is a lottery with them.

    Sadly it was only option for some countries. Also it wasn't so wide spread issue before with haslabs.

    I was referring to the Taiwan customers who lost theirs due to water damage.

    Hasbro is in an even worse position with the Zavvi orders....there was never a plan for those. But Zavvi canceling the order and providing refunds is their only real option as its not like Hasbro has stock unaccounted for because of this.

    Refunds are really the only option at the moment because there's no way Hasbro is going to take (or keep) anyone's money without knowing for sure how they could make and distribute replacements.
