    That is exactly correct.

    At least in the same way that slapping a Volkswagen emblem on a marital aid might be considered a "knock-off" Volkswagen product. A knock-off is usually something the closely copies the design of an official product... but sometimes a pilfered logo might serve as well.

    The question of whether 3rd Party items are "KO" is heavily dependent on what a court might deem IP theft or "fair use" ... but that's a wiggly line.

    Either way, the very term "knock-off" itself isn't really under debate... just where that line is.

    "KO" products AREN'T illegal, at all. "IP theft" is a different matter, as something is either "IP infringing", "counterfeit", or not.

    Who said anything about illegal? You ok, bud? You seem a bit like you're trying to argue something, but without anything to oppose. :wink: 

    The line between those categories is usually falls to some kind of legal proceeding to determine. The majority of KOs (as we know them) and many 3rd Party figures would likely be judged as IP-infringing in most contexts... but pursuing those suits, especially across national borders, is probably more trouble than it's worth most of the time. I for one am quite happy that Hasbro is not particularly aggressive in that respect.

    Well, to be clear, a knock-off isn't "IP infringing", either. It's a case of "innocent until proven guilty", so the status would simply be "IP infringing" or not. For example, some products, to the layman, might not seem like a "knock-off", but they have been found, legally speaking, to be "IP infringing", such as various (mobile phone) technologies.

    The layman's relative level of ignorance is immaterial in that case... but yes, "IP-infringing" and "knock-off" may not always be coterminous definitions, particularly when moving through fluid social and institutional paradigms.*

    * I suppose one question might be "Is it really a knock-off if it's not IP-infringing?" This follows the logic that these things are not in some kind of quantum state like Schrodinger's cat, and that the inherent quality of infringement is present independent of a legalistic determination, recognized or not. This is a valid philosophical approach, and cannot be dismissed out of hand. Likewise, does a commonly-understood "KO" then cease to be a knock-off if an official determines it NOT to be IP-infringing? It's possible that a pervasive degree of derivation may be essential to the whole concept of what a KO is, the absence of which retroactively challenges an object's popular perception as such.
