I'm gonna go with the artist being the asshole. No editor is going to scour the internet to make sure that a weapon in a licensed comic wasn't stolen from DeviantArt. Shit like this happens A LOT in comics... crap, I forget the artist's name, but they'd legit trace photos for comic panels... ugh, they did a bunch for Marvel when the Ultimate line was still around with Ultimate Fantastic Four and they're still getting work.
It’s entirely possible that the artist just Google Image searched for RWBY guns and found that. That has happened before with different works.

I sometimes wonder if they'll ever do a remake/remaster of volumes 1-3 with those new models. Hell, maybe the original four trailers while they're at it.
Spoiler Nice as it is to have Penny back, the cynic in me wonders how long until there's a twist or if RT's just rebuilding goodwill from Vic's lawsuit, the crunch time reveal, or just the feedback to the Mistral arc.
Spoiler I saw Penny coming back from a mile away ever since she "died" since she's a machine that can be rebuilt (complete with creator/father silhouette foreshadowing). It was just a matter of when, and revealing her while the group were in Atlas was the perfect way to do it. As for the Vic stuff, I don't think there are that many fans that lost goodwill over that, and I don't particularly care about him either after this whole fiasco. As I was watching the new episode, I almost completely forgot that it was someone else voicing Qrow.
I've thought about that. A shame, but understandable. But volume 1 and parts of 2 really are quite rough, visually speaking. This scene on the rooftops has always irked me:
loved the intro and really dig the new VA for Qrow. VERY interested to see where things go this season
