Man. I kinda WANT all 3p companies to get shut down so we never get these discussions again. OR Hastak goes belly up and transformers becomes ruined forever by some random ass company and all the toys are just soap bottles or something.

I always find the 3P IP discussion interesting, but I think it's trumped by Hasbro's seeming lack of interest in getting it shut down, they've never taken any of them to court and probably never will since they aren't actual competition. Sure we adult collectors buy 3P stuff (some more than others) but we also all eat at the Hasbro table too, along with all the children and parents, the real toy market.

 

Who said I compare 3P with KO? And what Marvel allows or not is not up to me nor you. And it does not serve as an example. Technically they have to sue third party if they get wind of their product, as to not lose their copyright. So they turn a blind eye as it would be a massive undertaking. And then it would be defined by law what is and what is not under the licensing. So don't think that what third party does is legal. They simply ignore it since it isn't their prime market and it barely hurts them. At least Hasbro. Takara with its Masterpiece line has more to deal with it but I am not clear how it works in Japan.
As for the western world, Hasbro actually has the obligation to act if they know about it. But they act as if they don't know. So they still keep their copyright. They said as much at Botcon years ago "don't tell us about 3P" was their message. And that is the cold hard legal fact.

 

Be assured they are watching. As soon as 3P gets into their toy market they will come down on them with the sledgehammer. But the few Masterpieces like MP10 and the Soundwave set are not something that warrants them to go after them. Those are rare releases. They leave the MP style figures with Takara. If they were to KO toys or make kids toy versions of their IP they will act.
They just pretend not to know due to legal obligations, which in turn protects their IP. Nobody is waiting for a lawsuit on this issue. Lego for instance went and lost.

Anyway, they never really can break into the normal toy market due to their prices and the fact that they know that Hasbro's watching too, they'd rather be Hasbro's free market research than their actual enemies. I do not believe for one second that CW would have happened without the 3Ps proving there was a market for combiners.

 

I would personally disagree, I think it's more like if IDW used Spider-Man with no spider logo and called him Arachnatus Sapion. There would be cease and desist's at the very least. I think it's more that Hasbro finds them useful for seeing what collectors want without taking a risk themselves.

 

If what you say is true, than why would anybody license cars, you could call it automotive look.

As soon as you Mass produce a custom product based on an existing IP it's theft.

I'm not saying I haven't bought 3rd party before I'm saying it's a terrible idea to loudly promote it over the official product.

These 3rd party companies aren't originating in the US. Hasbro has difficulty just shutting down KO's (exact copies) also these companies frequently change hands and names when legal trouble does find them.

Okay sure. Maybe it is. But that’s ultimately their decision to say so. And they seem to have long since not gone on to talk about it then you claim it to be a loud claim. Just saying.

why is this degrading to a 3p vs official discussion. siege toys are not mp, do you really think it would run you 150 for a mp omega? 75 for an mp jetfire? no way. besides they are too greebly for mp in design alone.

so if you want an mp omega or jetfire, 3p is really the only way you are going to get that (at least for the foreseeable next couple years). if you want nice classics/siege themed toys, well there you go.

there is no direct competition here besides people buying placeholders that dont want to stretch their wallets. these toys are not mp aesthetic and if you are looking for that your choices for now are really buy 3p or wait.

 

Maybe we should legit leave it for now.

At botcon they gave an answer, as to not mention 3p.
They know it exists but ignore it. And that is the company policy. Simply that they have to fight them if they acknowledge their existence. Legal limbo.

 

I am mainly a tf toy collector. Mostly combiners and main stayers. The jetfire figure really got me itchy since I got the takara leaderJetfire figure.
But those extra details like the flip emblem and the bits that make his g1 toy really got me interested.

 

Indeed the art for these two is almost as good as the old G1 back of the box art.
