A- You should have packed them better and you know that.

B- Never, ever, ever ship to Italy. In my experience, no matter how well you pack it the shit will get smashed or disappear off the face of the Earth.

C- The fact that he plans to resell in no way, shape, or form affects the difference in value of one with or w/o the case. Suggesting otherwise is idiotic. You are in no way responsible for his profit margain. It won't be a factor in the dispute no matter how much he may cry about it.

D- The only thing you owe him if he decides to keep them is the differnce in value for the damaged items. If he wants to return the 5 then refund the cost he paid for those 5.

E- A partial refund of shipping cost would be a nice "good will" gesture.

F- Never, ever, ever ship to Italy. (Yes...I do know I already said that)

I think it's obvious at this point that the packaging was insufficient. But if I were you I'd settle with the buyer before Paypal steps in. There is a statement that says a buyer can make a claim for refund if an item is significantly not as described. I think that may apply here. Paypal might just give the guy all of his money back. Then you'll have to worry about him mailing them back to you. Trust me I've been on both sides of the fence with Paypal claims. The buyer always wins.

Sellers always say that Paypal favors buyers.
Buyers always say that Paypal favors sellers.

    It goes both ways.

Just last week, a friend of mine purchased what was supposed to be a 1950's yellow telephone. When he got it, he found out that it was really a white phone that was badly discolored. Clearly "not as described", right? Paypal sided with the seller.

I temporarily removed the content because I needed contrast, it's very hard for me to make pictures of transparent stuff, and the paper inside was white too.
I put everything back together, they are on a table in layers of pluriball.
And... yes, it's not the same trays all the time but all 13 of them.

Before seeing these pictures, I offered a $69 refund as detailed in this thread, to which the buyer replied that a 30% refund of the total ($144) was more reasonable.

I personally wouldn't settle for a $144 refund. If he's willing to, you should accept it.

apparently there is one crack in the side that goes all the way to the top on one of them, and two others have a 1/10 inch crack in one corner.

And there are surface scratches as you would expect on anything hard plastic that does not have the sealing plastic around it.

In my opinion, requesting a 30% refund off the total from this is ridiculous, and I am going to retract my $69 offer. This surface damage will make no difference at all to the value of an incomplete toy.

But I'll pack better the next time.

The limited editions of the Micron Legend (Armada) DVDs were sold with free minicons packed-in in Japan. They are very rare, I believe there were 1000-1500 of each, but don't quote me on it. The buyer is complaining about the condition of the piece of plastic that was used to support the figures when being packed with the DVDs

how disappointing. Now no "officials" will confirm that I'm right, probably leading to "eternal bad feelings".
