Hasbro has to approve it first. If they allow this design to get released, it means they don't feel any legal threat from Harmony Gold.
I thought that was taken care of with the whole GI Joe crossover thing? I thought the out of court settlement resolved any future issue with Jetfire. Or maybe I dreamt that?
No, I thought Hasbro lost that one that's why they were trying to get everyone's back they probably filed a cease and desist then seizure of chattels against Hasbro. This looks nice, maybe Robotech/Macross people will pick it up too.
This will go straight into my Macross collection if it actually comes out looking like that. Hopefully they'll do a Skyfire, too.
We'll never know what the settlement's details were. For sure one would be to let them sell the Skystriker which the lawsuit was about. And we can also assume that HG let Hasbro do Leader Jetfire as part of the settlement. But HG would never, ever agree to Hasbro getting a Hall Pass for any and all future Jetfires, and especially not to then pass on that license to third parties.

Not really. It was "Dismissed with prejudice" because HG and Hasbro settled, and because they settled, the case is dismissed with neither party being held at fault. "With prejudice" means HG can't sue Hasbro again for the same thing. "Dismissal without prejudice" lets the plaintiff sue the defendant again (usually when more evidence is uncovered or after an agreed amount of time). If there is a settlement, there is nothing for the judge to rule on, so he can't "side with" anybody. As long as the two parties agree, the judge will then dismiss the case (since usually part of the settlement agreement would be the plaintiff withdrawing the suit/filing a motion for dismissal). A judge will only get involved in settlement issues on very rare occasions.
