Keep in mind that they have a chunk of Scorp's tail (not to mention any pieces they didn't throw in the ocean). It would make sense that they would try to build a weapon to defend themselves and if I'm not mistaken, the toy changes into a tank, does it not? It wouldn't suprise me if Megs sort of "borrows" their new toy.

Also, I highly doubt that the U.S. Army is going to rebuild Megatron. He's pretty much dead already, his left arm and right leg are gone, and he's clearly droped into the ocean. The chances of the U.S. Army bringing him back up out of the water are like their chances of raising the U.S.S. Monitor or even the Titanic.
