I know the batch of figures that snuck out weren't the final production ones, but the packaging looks to be pretty final. OTOH, maybe it's just not there. Phoenix, reg. or Dark, wasn't on the ML VI backs for some reason IIRC.
There was a list of this wave that showed up a while back that took everybody by surprise at the time to say the least. Is that list still floating around and does it mention the 10th fig? |

Upper left corner..that be an ASM logo, yes? Looks like issue #301 at that. Maybe the 10th figure is a basic Spidey repack.
Edit: Or not...the comics in those packs don't make any sense. Ant-Man still has the inexplicable Venom comic, Sentry and Havok have the kiddie SM title, Wolverine AF 15, etc. The guy in Kansas that found them, the comics were nonsensical placeholders like that. |

I found an online site that accepts preorder for them but I heard that those 9 figs may not be in the final production but it's odd how a guy manages to buy them from a store. 
All my toys for sale can be found here

Somehow instead of being shipped back to Toybiz, it got shipped to a Walmart, and they put it out on the floor. CobraIsland.com |

Not his fault that some dingus at a WM in Kansas fucked up. I'd have put them on Ebay too after the truth came out. They'd probably zoom to ~$100 each easy. Marvel/TB ought to be happy for the free publicity; they couldn't have planned something better. |
