I think she got fired from her job as Mikaela and they wont address what happens to her, once your fired you dont exist to companys anymore, even if they mentioned her Im sure they would have to pay her for the name drop, and I cant see that happening.

Actually, the actor owns nothing about the character. The only people who would get money for the mention would be the people who created the character (the original writers). However, just a mention is probably not enough to garnish them any royalties.

I think it'll just be broken up. Either A-He's going to come to his senses and think maybe the dumb bint with the spray-on-tan and fake lips isn't what he's looking for, B-she'll just be a total bitch, get bored with him and move on, or C-Sam will miss a payment to her pimp!

She doesn't own the character. She has no rights to it. ZERO. Paramount/Dreamworks owns Mikaela Banes and they can do whatever they want with their property.

But unless the actor actually appears in some form (audio, photo, footage etc.), there's no way in hell a mere reference to the character, which is owned by the production company and can be recast if they like, could demand royalties.

I dont think any of those examples were breaches of contract, and to be honest I dont know if Megan Fox had a 3 picture deal with them, but if she did wouldnt that cause an issue? Im just saying what if, not trying to get blungened to death for making a comment. I might add that some actors continue to get royalties long after their roles are over, for example William Shatner still gets royalties off all merchandise that directly involves him or the Star trek name, it just comes down to whats put in a contract. I am merely curious on Megan's part what clauses were in there.

 

I assume he gets royalties for everything that bears his likeness as James T. Kirk.

I highly doubt it includes a clause that says "If your character is referred to by name, it counts as an appearance on your part".

It will vary from contract to contract, that's true. Hell, Jack Nicholson get's royalties from ALL Batman movies because he asked for that in his contract when he was the Joker.

Shatner may have gotten a similar deal when he signed on to be in the films. It all depends on what that contract was.

If Paramount/Dreamworks had a three picture deal with Megan Fox, what they would have done was bought her out of it. Of course, if she really quit like she says she did, then she would have had to pay them.
