Transformers Prime - The Tablet

    Transformer Prime gets official landing page, shows mostly bezel -- Engadget

    WTF. First they come out with the eee-pad Transformer, name of their netbook/laptop/tablet combo thing. Fine, Transformer as a word technically can be used outside of "The Transformers".

    However, their second version, is now called the "Transformer Prime". Someone over there likes Transformers, or is fucking with Hasbro.

    Unless there is a copyright on the title, and IIRC, titles themselves can not be copyrighted, only contend, they can use it. Now if it was TransformerS Prime, with an "S" then I think Hasbro could do something.

    Well, this might fall into the "popular trademarks" category, where Hasbro can take legal action against companies using well-known Hasbro trademarks (or "confusingly similar" names and terms) even in fields that Hasbro does not operate in. The main argument there would be that the other company is trying to cash in on Hasbro's good name.

    Mind you, I'm not saying Hasbro would succeed there, but following the success of the movies, their chances are considerably better than before.

    Last year they pressured a company into changing the name of a car navigation software from "AutoBot" to something different.

    They might not even need to take it to court. Some companies will cave in at the slightest threat of legal action.

    That's what I was thinking, but, I wasn't sure. The only case I can think of off the top of my head was Fox threatening to sue The Asylum due to the title of their mockbuster The Day the Earth Stopped was too close to The Day the Earth Stood Still. If legal action can be threatened over a few word difference, then I can see Hasbro going after a one letter difference when it comes to trademarked names.

    Well, see, as I explained in the other thread, usually "different category" means "no trademark infringement" if the original trademark holder doesn't operate in that field. It only works for really "big name" trademarks where the original company can argue that the other company is absolutely banking on customers associating the name of the product with the original company's trademark.

    It wouldn't work for names like "Grindor", "Thunderwing" or "Astrotrain". "Transformer Prime" seems a lot more likely for it to work in Hasbro's favor, though.
