I also think it had to do with the brutality of the crime - it was a prolonged beating in revenge for what had happened, to the point where the man's skull was cracked and he's suffered so much brain damage he couldn't even put in his own plea. And thanks, Cag! 20k into being able to make posts on a message board. Yay!
Most criminals do not come back - many are just people like you and I, but they've turned to criminality to support themselves. If someone threatens them and shows that much resistance, any criminal with half a brain would not come back. Under the eyes of the law, you can't be going all vigilante. If you managed to scare them off, you call the police and let the criminal justice system handle it. It may seem silly, but all of our laws frown on vigilantes. My apologies to Batman
Link to bookstore shooting Wesleyan University Student Fatally Shot; Suspect At Large - wjz.com I understand if this was from the U.S point of view. Since we inherited many laws from the U.K, I'm not aware of anything like this happening in the U.K since difference can apply. The victim simply didn't want to turn into this guy Farmer who shot burglar backed by judge - Telegraph The thing is people get caught up in adrenaline, especially cops. See this incident when the cops shot a man who was defending his home against the suspect the cops were chasing.
"Defense" is the key word.(Prevention or Intimidation) Using the gun with the intent to injure or kill would go under Vigilante/Offensive.
Ahhhh, here's where things get twisted though, It was Sun Tzu in "The Art of War" who stated, "To be certain of safety when defending, defend where the enemy cannot attack." Because of what a gun represents in terms of consequence, it becomes an offensive weapon the second it is pulled because it's threatening. It's like blocking a punch, you haven't defended, you've actually clashed and now it's just a race to whoever throws the next punch faster. With a gun, just pulling it one someone is also a clash. Pulling the trigger ends the threat with an offensive manuever. But, eh, one could argue semantics forever and never really get anywhere.
Sure, but if you're not cognizant of the ramifications your actions will have by law, then you never defended yourself at all now did you? Defense against laws is just as important and is as simple as being aware of what they are and not transgressing them. The whole emotional breakdown line is an excuse not a valid argument. People will be held accountable for their actions accordingly depending on the situation.
which means you just took the offensive by pulling a gun. from Tactical Dispositions (The Art of War) I don't make these things up...not my fault. This is centuries old.
I'm glad I live in Texas, where I'm well within the law to shoot you square between the eyes if you so much as look at my house.
"If I see you, I will take what I want from you. I got mine, I hope you.... [GOT YOURSELF A GUN]" So have anybody paid attention to the news enough to hear of something like this happening over there before?
Well when our house got robbed the man came through my window and I grabbed my baseball bat and smashed him in the knee cap and he ran off, am I going to prison?
The doors, walls and other structures in you house counts as defensive object. They took the offense by you not allow them in your house the first place. Therefore, they took the first offensive move.
I once had a dream about this. When I woke up, I was very sad I think it's coz the victacker is a devouted Muslim coming back from Ramada with his lil family. The judge is prolly super Rep, bleached or whitish hair, blue eyed, and very cracker. With a side of chubbness. Can you just imagine the judge talking like that, all calm like sayin "Now I know the public might burn my house down later, but our entire justice system might break if I don't do this. So...bear with me, because this hurts me more than it hurts you." And the dude beat the shit out of the burglar in his front lawn. That's technically still on his property! The guy should've crawled off into the street to save himself, and get a better deal with the wise ol judge
For the record, I know that what the brothers did was vigilantism, an immediate act of revenge and illegal in most places, including where I live. However, if anyone threatens the life of anyone that I love, they forfit their right to live in my eyes. I would rather be put to death for killing the man that tied up my daughter than live free knowing that she has to be afraid of him for the rest of her life. Society exceeds it's authority over a citizen when it punishes retaliation for a threat to life.
