need advise, False DUI DMV Order Supension

    I need some help or adivce.
    so today I get a letter from DMV that my Drivers License will be suspended on Jul 03-2008 for not apperaing in Court for DUI that I recived on 07-04-05 in Newport Beach, CA.

    The thing is I was never in that area on that so called date and the last time I was even in the LA or SoCal Area was in 2000, and that was just driving through. I went to DMV and they gave me the info to contact Newport Beach Court. I call the place and the representiva tells me the person that was given the DUI lived in Santa Ana, CA. She informs that can mail them a letter with proof or appear in person to fight this claim. I mean I would love to go in person to get this over asap but its a 4 hours drive and the gas prices aint helping either. Im gonna send them photocopys of all 3 Drivers License I ever had, Drivers License renewl forms, few bank statements and paypal invoice and college forms, all that have my address info since 2000.

    So the the help I need has this ever happen to any of you, and do you recommend I do or mail off?

    If you can provide a reliable alibi for the date(s) in question I think you'd be golden.

    I have absolutely zero experience with this -- in Indiana OR California -- but don't they... I dunno... arrest you and take your picture if they get you for DUI? Shouldn't it be as simple as them comparing their records to your photo and demographics?

    Yeah if they arrested you then they should have booked the person and took their picture. So they should just match the picture with yours and be great. They might have just mixed your DL up with one wrong number and they got you.

    I got a ticket a few weeks back for having an expired inspection. Got pulled over again a few days later but I didn't have the ticket to prove to the cop that I had already been ticketed for it and he couldn't find any evidence of me having a current ticket issued, but he could find a record of the officer running my plates or whatever when he pulled me over and he let me go with a verbal warning. They do make mistakes.

    Of course, he could have just been saying that to see if I didn't take care of the ticket so they could arrest me and get more money out of me...:confused2

    I want to know if you were ever stopped for a DUI somewhere else.

    Something about the wording of your post makes me wonder.

    But if not, yeah, I'd just send in paperwork and pictures, prove it wasn't you.

    yeap, my parents told me the same thing. Who ever got the DUI will have a picture, information about them and maybe fingerprints.

    nope, and the thing is I dont even drink. So I was suprised and my family too when I got this in the mail. I mean I couldnt even spell DUI right. I had to go the DMV and ask what it was.

    But all my info is in the mail now. thx for your help guys

    I was wondering about that. Though DUY was some new car related offense that I've never heard of or something.

    Just send in the paperwork and you should be fine. I had a similar thing happen, I got a letter in the mail about a ticket I had received somewhere up in Bumblescroo NY... meanwhile I'd never even driven anywhere NEAR there before. Turns out the cop had reversed two license plate digits when he wrote the ticket.

    It WAS a headache tho. But it was cleared up.
