If he is a cybertronian tank where is he when he scans it.... is the nemesis coming down with tanks on board or is megatron going back to cybertron?

Perhaps Cybertronians have "backup form presets" in their systems that they can use, depending on the environment they find themselves in.

transformers dont need to scan something in order to turn into it...they only scanned the vehicles on earth so they could blend in

Maybe someone physically rebuilds him as such.

Maybe Soundwave gives him a tasty plate o' tank schematics. And he eats it.

...the whole plate. THE WHOLE PLATE.

This is actually mentioned in "Ghosts of Yesterday".
They keep a record of any vehicle modes they have scanned for future use.

I would also say that Megatron's altmode as a Cybertronian tank does not need to be scanned, because it is not a disguise transformation. Guess he's just like many G1 season 3 characters like Springer, Blurr, Cyclonus, Scourge or Galvatron etc. who transforms into vehicles which does not exist on earth.

I think Soundwave gives him his new form. Or some other Decepticon that's loyal. And I like this new form that Megatron has, because it just reeks of his viciousness and brashness. He's one of the few that doesn't give a slag about being in disguise. He's purely a weapon. That's why this Megatron is so scary. He will go so far as to alter himself permanently to win, because he's an emotionless machine.

And I hope they leave Galvatron out of this incarnation. Megatron is vicious enough and obviously powerful enough. If he gets anymore upgrades, they'll need a nuke to stop him.

Why cause you dont like it???

Seems like a very plausible explanation to me.

    Thats an assumption.

At the time, 1986, the designs for Blurr Hotrod and the rest were considered futuristic earth vehicles.

I think he has his body rebuilt in the film. I mean look at him when he was dumped into the ocean, he`s missin` an arm and a leg. And if you look a the ROTF Megs, he has one arm from his old body. Maybe the Constructicons do it? Good way for them to show off in the movie.

Interestingly enough, small children have imaginations and short attention spans. They don't need, nor do they like, long explanations. They pretty much just want to see some good guys and some bad guys shooting at each other. In terms of adults, they're one of two groups as I see it: Us, and those who are shuttling those kids mentioned above around. The former I'm sure will get an adequate explanation. The latter could care less because they're pulling gum from little Sally's hair.
