Fan Art: Fanart being censored! D:

    They are censoring fanart now! Doesn't that take away from an artists expressive freedom, so anyway a little laserbeak told me that on a major website for sharing fan art that they were taking down some artists works because the art contained "Faction Symbols" which were official to the Transformers brand.

    So the letter one artist received after questioning the art being pulled was this

    "Hi there,
    Actually that is the case. Using a copyrighted logo/symbol could land *removed website name* with a lawsuit for said use. Anything that is an official logo/symbol/artwork etc of something that is copyrighted cannot be used here without causing us alot of trouble. No matter if it's the actual thing or your drew it yourself to look like the actual symbol, neither is allowed unfortunately.

    Not all Transformers art on here uses said symbols actually. But any that do need to have the logo removed otherwise it is in violation of rule 6h. *removed name* is correct with their comment hence why that piece was marked as in violation of 6h and we have asked for the removal of said symbol.

    However I do ask that you please not just blur out said symbol and instead colour over it so that that particular part matches the rest of Bumblebee's body. As you say you have a seperate file with said symbols it shouldn't be too hard to remove the symbol which I see you have now done.

    Thank you for doing so. Your work can now be returned to your gallery for you."

    Would you rather have the site land in hot water for allowing copyrighted material posted?

    While I'm sure that Hasbro wouldn't care too much, the website needs to cover their ass.

    Without knowing what "website" or (I'm assuming) online gallery you're referring to and the content of the fanart in question, I can't really say much other than speculation.

    That said, the site hosting said images and fanart can do whatever they please when it comes to what's posted on their website and covering their own asses legally. This is why sites like DeviantArt have terms of service and posting/content regulations. If you have your own privately-hosted website you can post pretty much whatever you want. But if you're posting on a public gallery owned by someone else, you have to follow their piper.

    Well, you didn't name the site, so it's a little hard to figure out how much anyone should care. Besides, I'm pretty sure the site is just being insanely paranoid, so post your stuff elsewhere and... that's it, actually.

    So then all the fan art that contains faction symbols on this website has to be removed too or this site will get sued. :O

    Her stuff doesn't get removed from DeviantArt though. Either does yours and you have a Decepticon symbol on that Megs girl.

    good thing I rarely use faction symbols........but isn't that restricting us artist freedom

    Just use the Maximal symbol instead. Nobody likes Beast Wars. :lol

    Hasbro has given no indication that they plan to go after fan artists of any of their properties. So long as people aren't attempting to profit from the use of Hasbro trademarks, Hasbro has been pretty lenient in their allowance for fan created projects. Be it art or custom figures. If a specific website wants to follow copyright rules to an absolute "T" and not allow faction symbols on their TF fan art, it is their own doing and not Hasbro coming down on them.

    ... could hasbro ask to have anything with a faction logo pulled? yeah its their copyright after all... will they?... no

    Hasbro loves its fanbase they would not suddenly pull a 180 on fan art unless their was money involved then its a case of brand protection

    Then staff on the site are overreaching and the artists should find a new community. Like us.
