eBay problem - need advice

    So I won this rodimus off of ebay.

    But here's the problem - it never showed up. The seller swears that he shipped, and I believe him. I honestly blame the USPS, they're horrible sometimes.

    Here's the thing, the auction lists insurance as optional, but it wasn't included in the check out/invoice when paying. I definitely would have paid - I typically do when dealing w/ eBay and even ad hoc purchases here and there.

    At this point, do I have a chance of getting my money back? Should I stick it out and wait for it to possibly show up?

    I would. The seller definitely looks legitimate--small-time, but hell, so am I (exact same feedback, even).

    18 days is a while. I'd ask him when he sent it, give it three weeks from that day. Then at least talk to your local USPS, see if they can run a trace on it. But I wouldn't expect your money back from the seller. From his viewpoint, why should he? That sucks, but that's life.

    Did you call your local post office to see if maybe it's sitting there? Sometimes the mailman forgets to leave a pick-up slip for packages you missed.

    The first thing I'd do is get a delivery confirmation number. If he didn't get one (he's required to), then he's at fault, regardless of his claim that he already shipped the item.

    Ebay will side with the buyer in most cases under these circumstances if he can't produce the number to them.

    Whether you two want to make a compromise otherwise on what to do from that point is up to you.

    I've been down this exact road once before, so I feel for you.

    yeap, get the date when it was mailed and what shipping USPS service he used, Priority Mail or Parcel Post and if there was a Conformation (tracking) Number used?

    for $10.00 shipping that would be enough to cover Priority mail, a conformation number and insurance. I hate sellers that charge rape shipping prices and still ship cheap. I sell on ebay and I charge exact shipping for anything weighing more than 1lb anything less I charge a resonable price.

    If the package is lost, the seller would have to get some sort of "Lost package" Form at the post office. Im not familiar with this service but I heard it can take weeks or months to finlaize the investigation, and I dont think you get any funds if the package is lost

    The only other option you got, the seller would have to refund you half of the $60.00. Technically this shipping lost or delay (I hope) aint the sellers fault nor yours, but the mails. So this would be a even lost on both ends. I done this before for buyers and the same has been done for me as a buyer.

    just hope the package comes. sometimes the mail can delay on some packages.

    So far he's being a bit of a jerk, but at least communication is constant during this screw up. He seems like a nice guy but he's on the defensive right now.

    I don't blame him, but he seems to think I am blaming him. He shipped the item out on either august 2nd or 3rd (he mailed me on the 2nd, but I think he dropped it off late that night). I understand his point of view, the item shipped, end of story. If only things in eBay were that simple.

    I need other peoples opinions. In his auction he lists insurance as optional for $2. I didn't speak to him about it because I figured like most sellers it would be in the invoice as optional if I wanted it. But it wasn't. Am I at fault for not buying the insurance in this case, or is he at fault for not listing it properly? Are we both at fault for not being more careful?

    Doubtful at best. My post office typically leaves stuff regardless of signature required or not. The only thing they don't leave is the delivery confirmation w/ mail back responses.

    I've gotta call you out on this - delivery confirmation is not required anywhere on eBay. If it was, then no one would have any issues on eBay - "oh, your package wasn't delivered. hmm ::checks:: you're right it wasn't."

    I thought about this approach, filing a lost shipment. I think the best you can do is get back the shipping fee. He's saying shipping was $10.55 or something like that (he used it in more of a feel sorry for me i undercharged shipping tone). No confirmation # or anything.

    Technically yes, but it is required to be used under the PayPal seller protection policy if that's how the auction was payed for. Regardless, it's a free service if the packing slip is printed out over the Internet.

    Why any seller WOULDN'T use it is a mystery to me. It's a required cost in my seller auctions and I've never had a problem.

    Well i had a similar story. A pakcje was sent for me, but only arrived 4 months later...
