    If the dude egged or dared his spouse to jump out of the car then perhaps he should be liable. Anything short of that then no way should the guy be liable. Not even if the guy, after trying convincing her not to jump finally got fed up and said "fine, jump". Even if he said that then no way should he be liable. Maybe he should have stopped the car but it'll be easy to argue that he did not really believe she would be crazy enough to jump out even if she threatened to jump.

    yeah ummm.... ok lets say this did set the bar it turns this kinda situation into a bit of a catch 22 if he lets her jump its his fault and if he does try to physically stop her its a driving offence.

    I hope this gets thrown out

    This will just curtail anyone from wanting to be a designated driver in the future, and we'll have more drunk drivers.

    If the judge is smart, he'll throw it out.

    Another thing I love about this site, everyone posts the greatest facepalm images :lol 

    Other than that, I just facepalmed myself. This is just so ridiculously stupid. Honestly, I've seen people get drink a few times, there's no stopping them before and after they've started drinking, and no stopping what stupid shit they pull afterwards.

    Is'nt there an idiot law that's being broken somewhere here?

    Can't understand how something so dumb could even make it to court in the first place.
    Wish there was some type of pre-jury to determine if it's worthy enough to be a case or not, and let them carry shotguns. Before more tax money is wasted.

    FUNNY story! I had something like this happen to me where a friend of my fiance was drinking and driving her tire explodes because she drive it onto a side walk. So she calls me and my Fiance asking to give her and her friends rides home. I KNEW it was a bad idea, the girl was well under 21 and i was 21 so i could only assume what the police were ganna think. So after we pick them up we are driving them home and my fiance goes off on this girl telling her to get her shit together and what not, the girl cops an attitude back and my fiance then says " GET THE F*CK OUT OF MY CAR" so i slow down and then my fiance says " Just drive them home" so i start to pick up speed again. The drunk friend then processed to step out of the car that i never completely stopped. I run over her foot and shatter the shit outta it. Luckily i never actually got sued, but her family tried. The tow truck driver told the police that they were drunk well before my fiance and I showed up. It was complete BS that i had to be put through all the nonsense.
