Courtroom Full Of People Locked Up Because of Cell Phone

    NIAGARA FALLS, N.Y. -- A New York judge who jailed a courtroom full of people over a ringing cell phone is off the bench.

    Judge Robert Restaino was removed Tuesday by a state judicial panel.

    During a court session in March 2005, Restaino got upset when a cell phone went off.

    He demanded that the phone be handed over, threatening to lock up everybody if no one came forward.

    When nobody did, the judge ordered all 46 people in the room hauled off to the city jail, where they were searched.

    Those who couldn't post bond were shackled and bused to the county lockup.

    Later that day, the judge let everybody go after being told reporters were calling.

    The chairman of the New York Judicial Commission said Restaino "snapped" during what he described as "two hours of inexplicable madness."

    Restaino said he had been under some stress in his personal life. His lawyer said he plans to appeal.

    Uh, couldn't he make a good case for a comtempt of court charge? If everyone refused, they're all in contempt. I don't see the issue here.

    He wanted the person with the phone to come forward. That person didn't come forward, so he locked up the entire courtroom.

    The issue is that you can hardly hold forty-something people responsible for the actions of the one in contempt.

    EDIT: I'd have resisted arrest. It woulda been my civic duty.

    The problem isnt everybody refused, just one person did. Everyone else was wrongly punished.

    Maybe he had a stroke and thought he was an elementary school teacher that day.

    I completely agree with squirrelcar, I would have resisted. I can't believe all the people in the court room allowed themselves to get victimized and have their Constitutional rights taken away.

    Anybody smell a lawsuit?

    Well, I've always thought everyone with a cell phone should be locked up, so this is a step in the right direction. :p

    I'd have just shown Bull Shannon I didn't have my phone on, I had it turned off like a respectful citizen and thanked him as he let me go.

    If I had been detained my first call would have been to Denny Crane. He'd shoot the judge.

    Think maybe we can get you to come patrol the streets here in Mi. and lock up the folks you see talking on the phone while trying to drive?.....I'd really appreciate it :D

    This sounds exactly like junior school. 1 person wont fess up, so the whole class gets punished.

    What a stupid judge. There are too many idiots on the bench in this country. At least this is one less dope we have to worry about.

    I got into it with a baliff when I went to jury duty. As we were about to take a break, someone's phone rang. Natural instinct was to look at my phone and make sure it wasn't mine. He told me to turn it off, I said it was, he called me a liar basically it was a lot of fun. Fortunately, one of the other potential jurors I had been talking to all afternoon stuck up for me and told him it wasnt' me. What a dickhead.

    Pays to make friends with strangers sometimes.

    For once, we agree. I don't know if I would've ratted the guy out, but I would've definitely put up a fight against the cuffs and the arrest. He might've had judicial immunity, but he wouldn't have had baseball bat immunity.

    Yes, it does. It also helps to make friends in high places.

    How can ANYONE be such a dumbass as to not turn off your phone is beyond me. But, on the same token I have been forgetting to turn off my phone at work. Thankfully my friends are at work, and don't call me! I do have family, but they don't call often. I try to break up stress when possible with humor.

    Had I been the Judge I would've said something along the lines of "would you either put that phone on vibrate, or somewhere near your head where both are likely to be away from any sunshine?"

    While I find cellphones pretty annoying, what really pisses me off to no end are the people who overreact to a ringing cell phone. Sure its annoying, but fuck you for being an even bigger asshole who pretends that they have never forgotten to turn a cell off in their entire lifetime. Also, I just love how their reaction to a cell is even more distracting and time consuming than the 2 seconds it takes for the idiot to dig the cell out of a pocket and switch it off.

    Also, I should note that I ALWAYS have my cell on vibrate only. This is a simple courtesy to others, and allows me to keep my phone on at all times. I have taken it out of silent mode only a couple of times, and that when I was at home and expecting a call. Also, I say to others (females are the only ones guilty of this) to please keep your phone in your pocket and not in your bag. It makes a whole lot of noise even when its only set to vibrate mode.
