The revelation of a possible fourth victim of Fentress' sexual attacks came at a hearing in Riverhead to determine whether Fentress, 64, is mentally well enough to be transferred from a high-security mental hospital to a lower-security facility -- or to be released into society.

In 1979, Fentress, then a teacher in Poughkeepsie, pleaded not guilty by reason of insanity to charges that he abducted Paul Masters, 18, sexually abused him in his basement, then shot him to death and ate parts of him.

Fentress spent several years at minimum-security institutions until 2002, when two witnesses testified he abused them on several occasions in 1979, and a judge sent Fentress to the maximum-security Mid-Hudson Forensic Psychiatric Center in Orange County.

Fentress, who had been diagnosed previously as a pedophile suffering from "sexual sadism," has said he killed Masters during a stressful time in his life in 1979. However, Dutchess County Assistant District Attorney Edward McLoughlin said yesterday that he recently learned that Fentress sexually attacked another 18-year-old man in 1976.

McLoughlin said the man was briefly staying in Fentress' home when Fentress came into his bedroom in the middle of the night and made sexual advances. McLoughlin said the man fought Fentress off, then "barricaded his door" so he would not return.

When the man confronted Fentress the next morning, Fentress blamed his actions on "sleepwalking," McLoughlin said.

Fentress' attorney, Kim Darrow of the state Mental Hygiene Legal Service, said the new allegation had "no place" in the hearing, and State Supreme Court Justice James Catterson agreed -- barring testimony on the subject. Even without considering it, forensic psychiatrist James Lynch testified Tuesday that there is plenty of evidence suggesting that Fentress remains mentally ill and dangerous.

Lynch, who examined Fentress three times, said he continues to exhibit "denial, repression and justification," and remains unaware of "sexually charged environments."

As an example, Lynch noted a recent "illicit" sexual affair between Fentress and another male patient. Lynch said, if anything, Fentress needs more supervision, not less.

In his closing statement, Darrow noted that all reports from supervisors show that Fentress has never posed any danger to any patient or staff, or shown symptoms of a relapse or a major mental disorder.

Lynch conceded that, while he believes Fentress is mentally ill, he could not reach any diagnosis for him. In his closing statement, McLoughlin said there may be a good reason for that.

"Either science hasn't come up with the right theories or Mr. Fentress hasn't been honest," he said.

Well the kid was 18 so he technically wasn't a kid. But yeah this is not someone to release.
