A former San Francisco middle school teacher who seduced and had sex with a 14-year-old male student was sentenced to three months in the county jail and three months house arrest Friday.

Deputy District Attorney Rebecca Wagner told Superior Court Judge Herbert Donaldson that Nieka Arreola, 32, a former teacher at Luther Burbank Middle School, began “grooming” the student for abuse when he was 13 years old by giving him special attention, having him assigned to be her aide and giving him rides home.

Then she became more aggressive, Wagner said, initiating the relationship by putting his hand on her body and saying, “Why don’t you ever touch me?”

On Feb. 16, 2004, Arreola was caught when she was discovered partially clothed with the boy in a steamy parked car in McLaren Park, according to a police report. The boy later testified in court that on several occasions the two had sexual intercourse and oral sex.

While Arreola could have faced up to 10 years in prison, Wagner said, she accepted a lighter sentence of up to one year in county jail in exchange for a guilty plea, because there would have been no guarantee of punishment if the case had gone to trial.

“We wanted to make sure that she was going to see the inside of a jail cell,” said Wagner, adding that she was disappointed that the judge didn’t sentence the teacher to the full year.

Arreola, who lives in Oakland with her husband and newborn baby, will also have to register with the state as a sexual predator and will lose her teaching credential.

Her attorney, Ted Cassman, told the judge that his client had initiated contact with the boy to help him.

“Initially, it was an act of compassion that became twisted and wrong and she knows that,” he said.

Arreola cried during her sentencing but did not make any statement to the judge, nor did she look in the direction of the boy, now 15, and his family, who were also in court on Friday.

I would say that what really makes this a predatory, or manipulative act on her part is her station in the kids life. She holds a position of power and influence over the kid, and that right there is wrong. The fact of the matter is that most 15 year old boys would jump at the chance to get down with any reasonably attractive female that shows interest. It's less likely that a 15 year old girl would really WANT to sleep with a 30 year old man, hell, they barely want to sleep with boys their own age at that time.

When I was 16 I got involved with a woman who was 30. I didn't once feel like I was being taken advantage of, or being manipulated. However, I will say that every woman I've been involved with since then has her to thank for a whole slew of things... if you get my drift ;)

There are so many cop-outs these days. Infact, I think I read about some research once (unfortantly I cannot provide a source, and I'm sure my retelling of the experiment is grossly inaccurate) where they took two groups of girls going into puberty - they told one that they would suffer wild uncontrollable mood swings and be total bitches during their periods, and the others were not told of these wacky emotional changes - the group that was told they would be bitches acted in that extreme way, and the other group were a lot milder.

And of course then there's the over diagnosing of things like add, dyslexia and so forth - giving people even more excuses as to why they shouldn't do any work or ever bother trying.

*Note: Before I have several different people jumping up and down and yelling at me - "ADD and Dyslexia are real problems, not everyone is mis-diagnosed, etc" - Yes, I know that.*

Truth be told, in regards to the question, there was one teacher in high school, that I would've. Outside of that one teacher, any other, even if they were "asking for it?", I would've turned down at 15. However, I would add that it is probably meaningless, even if you could point out that nearly every example, both ways, it would've happened consentually, it doesn't make it right, acceptable, or endorse either light punishment or double standards.

I didn't have a single attractive teacher in all my years of schooling - college included, because I majored in physics.
